Local law enforcement in Minnesota can’t legally hold people in jail for the sole purpose of turning them over to federal immigration authorities, according to an opinion released by Attorney General Keith Ellison this week.

Last year, the corrections department held 13 people for ICE. So far this year, state jails have held six — the four currently incarcerated and two released to federal agents in late January.

Ellison’s opinion finds that “Minnesota law does not authorize state and local officials to hold or arrest someone based on an immigration detainer”
