A second lawsuit has been filed in response to alleged damages suffered from the Moss Landing battery storage facility fire on Jan. 16.

Crews have begun work on the first step of a long process in cleaning up the wreckage of the Moss Landing battery storage plant after a huge fire last month drew national attention and raised questions about the safety of a new technology needed to continue California’s expansion of renewable energy.

Smoke and flames were confirmed at the facility on Tuesday evening, but fire officials say the fire has since burned itself out.

A lawsuit was filed Thursday in response to the impacts of the Jan. 16 fire at Vistra's Moss Landing Battery Energy Storage Facility. Attorneys for Kim and Luis Solano, owners of The Haute Enchilada in Moss Landing, filed the lawsuit in the Northern District of California against Texas-based Vistra Corporation and other parties.

Cotchett, Pitre & McCarthy filed a lawsuit in the Northern District of California on behalf of the owners of the beloved Moss Landing Haute Enchilada Restaurant, Café, and Gallery against Vistra Corporation ("Vistra") for the Moss Landing Battery Plant fire.

Light smoke has been reported at the Vistra Battery Facility in Moss Landing. Monterey County officials say the smoke appears to be coming from the previously burned area within the Vistra Moss Landing Lithium-Ion Battery facility. It's been nearly a month since a large fire swept through the facility.

An attorney representing Haute Enchilada, Café, Gallery & Social Club says since the battery facility fires, the private club's business has dropped 50% of what it typically expects for this time of year.
